Abstract
هدف الرسالة: الوقوف على ما خرَّجه الإمام الدبوسي من الفروع الفقهية على القواعد الأصولية من خلال كتاب الأسرار، ودراسة توافقها مع الأصول المقررة في كتاب تقويم الأدلة، وبيان مدى تطابق تأصيله مع تخريجاته. وقد جعلت الرسالة في مقدمة وتمهيد وفصلين: تشتمل المقدمة على افتتاح وبيان لأهمية موضوع البحث وأسباب اختياره وأهدافه ومشكلة البحث والدراسات السابقة، وتقسيمات البحث، ثم تناولت في البحث المسائل الأصولية على الترتيب الآتي: الأمر والنهي، المطلق والمقيد، حروف المعاني العام والخاص المشترك والمؤول، الحقيقة والمجاز، الصريح والكناية الخفي والمشكل، الظاهر والنص والمفسر والمحكم، المجمل والمبين الدلالة الثابتة بالنص، مسائل التعارض مسائل الترجيح، مسائل الاجتهاد. ختمت الرسالة بذكر أهم النتائج والتوصيات.
Description
Thesis aims to: Examining what Imam al - Dabbousi produced from the jurisprudential branches on the fundamental principles through the Book of "Alasrar", studying their compatibility with the principles established in the book of "Evaluating Evidence", and showing the extent to which his originality matches his basis of joining. This thesis contains introduction, background and two chapters include introducing to clearing the importance of this research topic, the reasons for choosing it, its objectives, the research problem, previous studies, and the research parts. Then moving to interduce the fundamental issues in the following order: the command and the prohibition, the absolute and the restricted, the letters of meanings, the public and the private, the common and the responsible, the truth and the metaphor, the explicit and the metaphor, the hidden and the problem, the apparent and the text, the interpreted and the arbitrator, the outline and the clear, the fixed connotation of the text, the issues of contradiction, issues of weighting, issues of ijtihad. Finally, presenting results, recommendations based on the results obtained.
