In this thesis, each issue of the matter and its corresponding prohibitions will be discussed in an independent study, by mentioning the sayings in each issue with their evidences and by discussing them and by stating the reason for the disagreement. If it is possible, I will assess which one of the matters outweighs the other by mentioning the reason for it to exceed the other and the outcome of the disagreement. Then I will mention at the end of the topic the balance between the command and the prohibition and in which case the matter is preferred. There are three matters, the first is in the case of a command, the second is a prohibition and the third could be the both of them which can be applied together. The research will contain a preface in which I define the budget, the command and the prohibition. Then I follow it up with six chapters in which I discuss the issues with the most important results. Finally, I conclude it with a set of indexes.تناولت الدراسة مسائل الأمر والنهي، والمسائل ذات العلاقة بالأمر أو النهي (التي يؤثر دخول الأمر أو النهي عليها والموازنة بينهما بذكر أوجه الشبه، وأوجه الفرق. بحثت في الرسالة كل مسألة من الأمر مع ما يقابلها بالنهي في مبحث مستقل، بذكر الأقوال في كل مسألة، مع أدلتها، ومناقشة الأدلة، مع ذكر سبب الخلاف، والترجيح إن أمكن مع ذكر الترجيح، وثمرة الخلاف، ثم أذكر في نهاية المبحث الموازنة بين الأمر والنهي في المسألة المبحوثة، بذكر أوجه الشبه، وأوجه الفرق، وقد يكون الأمر في مطلب مستقل تحت المبحث والنهي في مطلب مستقل، وقد يكونان في مطلب واحد. ويحتوي البحث على تمهيد عرفت فيه الموازنة والأمر والنهي، ثم أتبعته بستة فصول بحثت فيها المسائل، ثم الخاتمة وفيها أهم النتائج ثم أنهيته بمجموعة من الفهارس.297ar-SAThesis
