| dc.description | This thesis includes an introduction، a preface، two chapters and a conclusion. The preface is a brief introduction about Al-orf (1) ، and its authentication. The first chapter talks about the conditions of Al-orf with AlHanabilah and its divisions and it was divided into three parts. The Second chapter is about the applicable side and it clarifies the matters based on Al-orf with Al-Hanabilah in judiciary and it was divided into two parts. This research paper will clarify that the scope of Al-Orf is considered a very broad subject that is constantly changing with respect to its time and place; people need to become more familiar with practiced Al-Orf in their residential area for which it is often judged based on the on events and dealings; in fact، the judge and jurisprudent when dealing with AlOrf requires broad knowledge in Al-Orf in order to make any judgmental decisions in dispute situations. | |
| dc.description.abstract | حوى هذا البحث على مقدمة وتمهيد عن العرف وتعريفه والفرق بينه وبين غيره، وحجيته وشروط اعتبار العرف عند الحنابلة، ومكانته ، واستعمالاته الفقهية، وأيضاً الفصل الأول من البحث حوى مسائل تطبيقية على العرف في باب القضاء والفتيا ، في أدب القاضي، وطريق الحكم وصفته ، وحوى البحث في الفصل الثاني على مسائل تطبيقية في باب القسمة، وكذلك على الدعاوي والبينات، وختمت الرسالة بأهم النتائج . ومن خلال هذا البحث يتضح أن فقهاء الحنابلة - رحمهم الله – عملوا بالعرف في مسائل كثيرة جداً ، وهو يتغير بتغير الزمان والمكان ، ويحتاج الناس إلى الاطلاع على العرف السائد في مكان إقامتهم ؛ لأن العرف يرجع إليه في الحكم على الوقائع والمعاملات ، وحاجة القاضي والفقيه إلى العرف أولى ، فقد يقضي القاضي ويفتي العالم بناءً على العرف السائد في مكان النزاع . | |
