dc.description.abstractWrongful termination of employment contracts is one of the most challenging and perilous issues in labor relations between employers and workers, given its profound effect on both individuals and society across various social and economic dimensions. Therefore, this research is devoted to primarily and thoroughly addressing the conception of wrongful termination within the framework of fixed and indefinite-term employment contracts and the issues encircling it through a meticulous and comparative analysis. Moreover, this study also endeavors to discover the three criteria applied in determining the wrongfulness of termination, derived from the theory of abuse of rights. Furthermore, it strives to confine all cases of wrongful termination of employment contracts with the aim of removing the ambiguity surrounding Article 77 of Saudi Labor Law, particularly regarding the criterion of wrongful termination. In the end, this study comprehensively elucidates the legal implications arising from of wrongful employment contract terminations, identifies the competent authority for hearing wrongful termination disputes, and provides the mechanism of procedures for claiming compensation for wrongful termination.
