dc.description.abstractThe Thesis focuses on the connection between dissenting judgments and the aspect of fairness in Australia by highlighting the importance of dissent and societal views, viewing different versions of fairness in dissenting judgments in two crucial cases (Mabo v Queensland) and (Carr v Western Australia), the rewards and risks of judicial dissent , and lastly judicial activism.
