Compensatory and Punitive Damages in the New Saudi Civil Law: Is There Emerging Clarity?

Abstract

This dissertation explores the concept of damages within the Saudi legal framework, focusing on both compensatory and punitive damages. It traces the historical development of damages in Saudi law, highlighting recent reforms introduced by the new Civil Transactions Lawa and aimed at better protecting individual rights. The study examines how these legal provisions align with international practices and identifies areas where further development is needed to ensure fairness and effectiveness in damages awards. This dissertation compares the concept of punitive damages in American law with similar principles in civil law countries. By analyzing the US model, the study proposes a legal framework for integrating and regulating punitive damages within the Saudi legal system. The goal is to develop a comprehensive approach that keeps pace with legal advancements and serves the interests of both the state and its citizens, ultimately contributing to the ongoing legal reform process in Saudi Arabia.
