Abstract

With the development of Vision 2030, Saudi Arabia’s decision to diversify its economy was inevitable. This led to the Private Sector Participation (PSP) Law, considered the cornerstone in achieving this vision. However, little research has explored the benefits and challenges of the PSP Law for investors. Furthermore, there are substantial gaps in the literature, with some studies so old as to be irrelevant to the Kingdom’s current situation and others, while recent, nevertheless written before the law came into force and the issue of its implementing regulations. This thesis derives from an in-depth study of the Kingdom of Saudi Arabia's attempt to attract and facilitate Foreign Direct Investment and Private–Public Partnership projects through reviewing and discussing the PSP Law using doctrinal and critical methods, before using socio-legal and critical methods to discuss the challenges that may face the Kingdom and investors regarding the implementation of this law. After reviewing the PSP Law, its implementing regulations and the amendments to all Saudi laws that contradict it, this thesis finds that the legal environment to invest in the Kingdom is promising, despite challenges for both the Kingdom and investors.
