An analytical and comparative study of civil consumer protection in electronic commercial contracts in Saudi Arabia

Abstract

Electronic commercial contracts are international contracts that are not affected by borders or geographical separations. Consumers are often party to them, and statistics indicate a recent increase in the number of consumers buying via the Internet. Also, in support of e-commerce, it is necessary to create a balanced and secure environment for the consumer and professional contracting parties. This study deals with the subject of civil protection for the consumer in e- commerce contracts at the stage of concluding an electronic contract. There are many consumer protection methods issued by modern legislation, as well as guarantees to the consumer in e- commerce contracts so that these contracts are more secure. This study was conducted in an analytical manner comparing Saudi legislation with the countries of the European Union. This study aims to identify to legal status of commercial contracts concluded electronically in Saudi Arabia and Is this protection different from what is in place in the European Union. The research is presented in four chapters. Chapter One deals with the general introduction about electronic commerce and commercial contracts concluded remotely and the necessity of consumer protection and background it, while the Chapter Two deals with the position of European Union countries on civil consumer protection in electronic commercial contracting. Chapter Three discusses the position of the Saudi regime regarding protection of the consumer in electronic commercial contracting and addresses the regulations and provisions in force to provide protection, despite the absence of a law specifically regulating contracts.to regulating them individually. The study ends in Chapter Four with a conclusion, results, recommendations and a list of references and sources.
