| dc.description | Abstract: This research examines "The Impact of Fear on the Rituals of Hajj and Umrah and its Contemporary Issues: A Comparative Jurisprudential Study." It includes an introduction that covers the importance of the topic, the reasons for its selection, its problem, its objectives, its questions, its limitations, previous studies, its methodology, and its plan. It also includes an introduction that defines fear, its impact, and Hajj and Umrah. It also included four chapters. The first chapter was about the impact of fear on the conditions of Hajj, in terms of waiving its obligation during times of epidemics, delaying it for those afflicted with an infectious disease, the unsafety of the road, and a woman not traveling for Hajj if she is not safe from temptation. The second chapter deals with the effect of fear on the rulings of circumambulating the Kaaba. It explains the ruling on circumambulating on the roof of the mosque, circumambulating wearing shoes, circumambulating on an electric cart, using medication to prevent menstruation, and circumambulating during the sermon. In the third chapter, I talked about the effect of fear on the rulings of ihram, in terms of entering ihram from places other than the appointed times, negligence and forgetfulness, walking and illness, and its prohibitions, in terms of fear of harm occurring, transmission of infection, or fear of temptation. In the fourth chapter, I explained the effect of fear on the Sunnahs and obligations of Hajj and Umrah, in terms of delegation, authorization, not spending the night in Muzdalifah, raising a woman’s voice in the Talbiyah, and the obligation to shorten the prayer for fear of transmitting infection. As for the study methodology, it followed the inductive-deductive, analytical, and comparative approaches. | |
| dc.description.abstract | الملخَّص يدرس هذا البحث: «أثر الخوف في مناسك الحج والعمرة ونوازله المعاصرة، دراسة فقهية مقارنة»، وقد اشتمل على مقدِّمة، تحتوي على: أهميَّة الموضوع، وأسباب اختياره، ومشكلته، وأهدافه، وتساؤلاته، وحدوده، والدِّراسات السَّابقة، ومنهجه، وخطته. وتمهيد في تعريف بالخوف والأثر، والحج والعمرة. كما اشتمل على أربع فصول؛ كان الفصل الأَوَّل في: أثر الخوف على شروط الحج، من حيث إسقاط وجوبه في زمن الوباء، وتأخيره عن المصابين بمرض معدي، وعدم أمن الطريق، وعدم سفر المرأة للحج إن لم تأمن الفتنة. بينما جاء الفصل الثاني: عن أثر الخوف على أحكام الطواف بالبيت، وبينت فيه حكم الطواف على سطح المسجد، والطواف بالنعل، وحكم الطواف على العربة الكهربائية، واستعمال الدواء لعدم نزول الحيض، والطواف أثناء الخطبة. وتحدثت في الفصل الثالث: عن أثر الخوف على أحكام الإحرام، من حيث الإحرام من غير المواقيت، والغفلة والنسيان، والمشة والمرض، ومحظوراته، من حيث خوف وقوع الضرر، أو انتقال العدوى، أو خشية الفتنة. وبينت في الفصل الرابع: أثر الخوف على سنن وواجبات الحج والعمرة، من حيث الإنابة، والتوكيل، وترك المبيت بمزدلفة، ورفع صوت المرأة بالتلبية، وإيجاب التقصير خوفا من انتقال العدوى. وأَمَّا عن منهج الدِّراسة: فسار على المنهج الاستقرائي الاستنباطي، والمنهج التحليلي، والمنهج المقارن. | |
