Abstract
الملخص
تناولت هذه الرسالة بيان معنى القواعد الفقهية، وأركانها، وشروطها، وأهميتها، وحجيتها، ومعنى الاستثناء منها، كما تضمنت بيان معنى قاعدة الضرورات تبيح المحظورات، وأهميتها، وأدلتها، وضوابط الضرورة الشرعية المعتبرة، والضوابط المبيحة للمحظور بالضرورة، ونماذج من تطبيقات القاعدة، كما تناولت المسائل الفقهية المستثناة من قاعدة الضرورات تبيح المحظورات، متضمنة المسائل الفقهية المعاصرة، ودراستها دراسة فقهية مقارنة.
وقد اشتملت خطة الرسالة على مقدمة، وتمهيد، وثلاثة فصول، وخاتمة اشتملت على أهم النتائج والتوصيات.
Description
Abstract
This research explains what jurisprudential rules mean, their main elements, conditions, importance, and authority. It also talks about what it means to have exceptions from these rules. The study discusses the rule “necessities permit prohibitions,” its importance, evidences, the limits of a valid necessity, and the conditions that allow something forbidden to become allowed in cases of necessity, with examples. It also looks at the issues that are excluded from this rule, including some modern cases, and compares them from a jurisprudential point of view.
The research is organized into an introduction, a preface, three chapters, and a conclusion that shows the most important results and recommendations.
