Abstract

This dissertation attempts to assess the application of non-custodial measures as alternatives to imprisonment in Saudi Arabia and to ascertain the strength of the legal framework put in place to achieve this. To achieve this goal, this research work will carry out a comprehensive discussion of the legislation enacted for the implementation of non-custodial measures in a selected jurisdiction- the Republic of Ireland, and then discuss and analyse the principal Saudi law, the draft of Alternative Punishments Law 2010 and see if it meets global standards and is adequate enough to reduce prison population, obviate or reverse some of the drawbacks of imprisonment. The dissertation also makes recommendations that may be applied to enhance the implementation of non-custodial measures.
