Abstract
الحمد لله وحده، والصّلاة والسّلام على من لا نبيّ بعده، أمّا بعد:
فهذه الرّسالة العلميّة تمّ تقديمها لكليّة الشّريعة بجامعة جازان؛ لنيل درجة الماجستير في تخصّص الفقه، وهي بعنوان: اختيارات الشّيخ أحمد بن يحيى النّجميّ الفقهيّة وآراؤه في قضايا مُعاصرة، في كتاب الجنايات والحُدود، والأطعمة والأيمان والنّذور (جمعاً ودراسة).
وقد اشتملت هذه الرّسالة على مُقدّمةٍ وتمهيدٍ وثلاثة فصول، احتوت المقدّمة على الرّكائز الأساسيّة المتعارف عليها في الرّسائل الأكاديميّة، وأمّا التّمهيد فقد تضمّن بيان جزءٍ من سيرة الشّيخ أحمد النّجميّ العطرة، كما احتوى على التّعريف بالاختيارات الفقهيّة، ومنهج الشّيخ فيها، والفرق بين الاختيارات والآراء، واشتملت الفصول الثّلاثة على إحدى وثلاثين مسألة فقهيّة، قام الباحث بدراسة اختيارات الشّيخ الفقهيّة دراسة مُقارنة بالمذاهب الفقهيّة الأربعة، مع بيان المعتمد في كلّ مذهب، وبيان الأقوال مع أدلّتها ومُناقشتها، انتهاءً بالتّرجيح الفقهيّ، كما اشتملت على خاتمة تضمّنت أهمّ التّوصيات والنّتائج التي توصّل إليها الباحث، كما تضمّنت الفهارس العلميّة المتعارف عليها، وقد جاءت هذه الرّسالة في بيان مدى اجتهاد الشّيخ أحمد النّجميّ وعدم تقيّده بالمعتمد من مذهب الحنابلة.
Description
All praise is due to Allah alone, and peace and blessings be upon the one after whom there is no prophet. To proceed: This scholarly thesis was submitted to the College of Sharia at Jazan University in fulfillment of the requirements for the Master’s degree in Islamic Jurisprudence (Fiqh). It is entitled: The Jurisprudential Selections and Opinions of Sheikh Ahmad bin Yahya al-Najmi on Contemporary Issues in the Books of Criminal Acts and Hudud, Food, Oaths, and Vows (Compilation and Study).
The thesis comprises an introduction, a preface, and three chapters. The introduction includes the foundational elements commonly recognized in academic theses. The preface presents a portion of the noble biography of Sheikh Ahmad al-Najmi, along with a definition of jurisprudential selections, the Sheikh’s methodology in this regard, and the distinction between selections and opinions.
The three chapters address thirty-one jurisprudential issues, which the researcher studied by comparing the Sheikh’s selections with the positions of the four major schools of Islamic jurisprudence. Each issue includes an explanation of the adopted view within each school, the relevant opinions with their evidences, a discussion of those evidences, and a final jurisprudential preference.
The thesis concludes with a summary of the key findings and recommendations reached by the researcher, as well as the standard academic indexes. This work highlights the extent of Sheikh Ahmad al-Najmi’s independent reasoning and his departure from strict adherence to the officially adopted positions of the Hanbali school.
