Abstract
هذا البحث عنوانه (أثر الحصار في العبادات دراسة فقهية) وقد اشتمل البحث على مقدمة وتمهيد وخمسة فصول وخاتمة. أما المقدمة فاشتملت على أهمية البحث وسبب اختياره والدراسات السابقة ومنهج البحث وحدوده، وإجراءات البحث، وخطة البحث . أما التمهيد فهو تعريف لمفهوم الحصار، ومشروعية الدفاع عن الضرورات الخمس وهي الدين والنفس والنسل، والعقل، والمال. أما الفصل الأول: فتناول أثر الحصار في أحكام الطهارة ، و فيه كيفية طهارة المحاصر الفاقد للماء وحكم استئثار المحاصر بالماء وشراؤه له. وحكم استعمال المحاصر للماء المغصوب، وحكم استعمال الماء للطهارة المشترط عليه بعدم استعماله لذلك. وأما الفصل الثاني: فتناول أثر الحصار في أحكام الصلاة، وفيه أحد عشر مبحثًا، وفيه أثر الحصار على الآذان، واستقبال القبلة وصلاة الخوف، وإقامة الجمعة وتأخير الصلاة، والصلاة في الجماعة، وقطع الصلاة، وتقدير أوقات الصلاة، والصلاة على الميت. وأما الفصل الثالث: فتناول أثر الحصار في أحكام الزكاة و فيه حكم دفع وتعجيل الزكاة للمحاصرين وحكم إعطائها للمنظمات الاغاثية لإيصالها لهم، وزكاة المال المحاصر، وفداء المحاصر من الزكاة. أما الفصل الرابع: فتناول أثر الحصار في أحكام الصيام، والحج، وفيه حكم إفطار المحاصر في شهر رمضان، واشتباه شهر الصيام عليه، واستنابة المحاصر من يحج عنه، وأثر الحصار على أداء المحاصر لمناسك الحج. وأما الفصل الخامس: فتناول أثر الحصار في أحكام الجهاد، و فيه حكم تخليص المحاصرين من الحصار والاستعانة بالكفار لفك الحصار، واستسلام المحاصر وحكم النزوح، والابتعاد عن الحصار، وحكم قتل المحاصر نفسه إذا خشي ضررا به أو بالمسلمين، وحكم إفشاء أسرار المسلمين للعدو، والميت بسبب الحصار هل يعتبر شهيدا؟، وأنواع حصار المسلم للكافر، وهدي النبي ﷺ في الحصار وأما الخاتمة وتحتوي على النتائج والتوصيات في أثر الحصار على العبادات.
Description
This research is titled (the impact of the siege on worship – juristic study) and the research has included an introduction, preface, five chapters and conclusion. The introduction included the importance of the research, reason of selection, previous studies, approach of the research and the procedures of the research. The preface: It included a definition of the concept of the siege and the validity of the defense of the five essentials which are the religion, soul, posterity, mind and money. The first chapter: It discussed the impact of the siege in the terms of the chasteness and I discussed the chasteness of the besieged who lacks water, the term of the acquisition of the water by the besieged and the purchase of the same for him, the term of the usage of the constrained water by the besieged and the term of the usage of the water for chasteness if it is conditional upon the non-usage of the same. The second chapter: It discussed the siege concerning the terms of the prayer and it consists of eleven sections in which I discussed the effect of the siege on the Azan, facing Qiblah, fear prayer, delaying the prayer, collective prayer, abandonment of the prayer, estimation of the times of the prayers and prayer on the deceased. The third chapter: It discussed the effect of the siege on the terms of Zakat and I discussed the term of the payment and acceleration Zakat for the besieged, the term of giving the same to the relief organizations to deliver it to them, Zakat of the besieged money and the exemption of the besieged from Zakat. The fourth chapter: The effect of the terms of fasting and pilgrimage and I discussed the term of the fast breaking of the besieged during the month of Ramadan, confusion of the fasting month, authorization of the besieged given to another one to perform the pilgrimage on his behalf and the effect of the siege on the performing the pilgrimage ceremonies by the besieged. The fifth chapter: The effect of the siege in the terms of Jihad and I discussed the term of releasing the besieged from the siege, using disbelievers to break the siege, surrender of the besieged, the term of emigration and staying away from the siege, the term of killing the besieged of himself if he feared any damage to him or to the Muslims and the term of disclosing the secrets of the Muslims to the enemy and if the deceased due to the siege is considered a martyr ? I also discussed the term of sieging the disbeliever by a Muslim and the approach of the Prophet peace be upon him concerning the siege. The conclusion: I discussed the most important findings and recommendations pertaining to the effect of the siege on the worship.
