| dc.description | Climate change is one of the most important environmental problems facing the world in the current era. It is characterized by a global nature that has its repercussions in the various environmental circles, in a way that affects all international societies, especially developing ones, which do not have the capabilities of confrontation and response, which requires concerted international efforts to confront and reverse it. Despite successive international attempts to address this problem, the international response remains weak due to the lack of international binding conventions in question, which calls for a study of the frameworks of these conventions with a view to establishing an effective and integrated legal system to ensure real climate protection, including effective principles and policies. International climate protection conventions, systems and provisions of international responsibility to ensure compliance by international persons with the requirements and Non-compliance, and this is based on deep-rooted in the area of criminalization and international accounting. | |
| dc.description.abstract | يعتبر تغير المناخ أحد أهم المشكلات البيئية التي يواجهها العالم في العصر الحالي، يتسم بطابع عالمي تظهر انعكاساته في الأوساط البيئية المختلفة بصورة تؤثر على كافة المجتمعات الدولية خاصة النامية منها، والتي لا تملك امكانيات المواجهة والتصدي، مما يستوجب تضافر الجهود الدولية لمواجهته وعكس مساره. ورغم المحاولات الدولية المتتالية لمواجهة هذه المشكلة، إلا أن الاستجابة الدولية ما زالت ضعيفة بسبب افتقار الاتفاقيات المعنية لمسألة الإلزام الدولي، مما دعا إلى دراسة أطر هذه الاتفاقيات بهدف إرساء نظام قانوني فعال ومتكامل يكفل تحقيق حماية حقيقية للمناخ، يتضمن في إطاره المبادئ والسياسات الفعالة المنصوص عليها في اتفاقيات حماية المناخ، ونظم وأحكام المسئولية الدولية؛ لضمان التزام الأشخاص الدولية بالاشتراطات والسياسات المعنية بالمواجهة، مع تعزيز الحماية الدولية لمصارف الكربون، وإنشاء قضاء دولي بيئي مختص يعنى بنظر المنازعات البيئية الناشئة عن عدم الامتثال، وهذا مبني على الجذور المتأصلة في مجال التجريم والمحاسبة الدوليين. | |
