| dc.description | Citing the sayings and deeds of the Prophet’s Companions on the jurisprudential rules is an inductive and analytical study. This research studied a group of the jurisprudential rules which have been incited from the sayings and deeds of the Prophet’s Companions. This topic is important for many reasons. First, it is related to the knowledge of jurisprudential rules which is regarded as one of the greatest, noblest and most honourable of Shariah’s sciences. In addition, it searches the issue of supporting the jurisprudential rules by citing the companions who are judged as good and are the best of the Islamic nation after the Prophet. Moreover, the importance of this topic is that collecting the sayings and deeds of the Prophet’s Companions from the different reference from which the jurisprudential rules can be inferred highlights and makes the evidences clear. This collection makes the companions’ sayings and deeds accessible to the researchers who want to study the jurists’ way of citation and sources of jurisprudential rulemaking. The citation of the companions’ sayings and deeds for the jurisprudential rules increases the surety in the jurisprudential rule, and strengthens the citation and reference to it when extracting the shariah rulings and verifying it based on the jurisprudential rule. This research achieves academic goals, the most prominent of which is the collection of jurisprudential rules on which the companions’ sayings and deeds were cited. These rules are the rules classified under major rules, and the holistic rules which are not the major ones. Of the goals is that it demonstrates the impact of the companions’ sayings and deeds on the jurisprudential rulemaking. Of the goals is the highlight of importance of the companions’ practices and their role in making preference in case there is a dispute over a rule. This research adopts the analytical inductive methodology that it gathers the companions’ sayings and deeds and studies the jurisprudential rules for which those sayings and deeds were cited for. The research talks about the definition through the jurisprudential rules, argumentations of the companions’ sayings and deeds. I collected the jurisprudential rules which the companions’ sayings and deeds were cited for in the books of sunnah, practices and rules. Then, I clarified the individual meaning by mentioning the meanings of the individual vocabularies, and the holistic meaning of the rule, its concept and what is meant from them. I mentioned the evidence of the rule from the sayings or deeds of the companion and the way the evidence was cited. I stated the impact of the companion’s practice on the rule which is not cited from their practices. I mentioned the scholars who cited the companions’ sayings and deeds for the rule. I then mentioned the practices which are textual reference for the rule. I demonstrated the scholars’ opinions about the rule and their differences about it. I mentioned their evidences which they cited while clarifying the preferred opinions in general. I stated the jurisprudential subsections and listed some of the exceptions of the rule, if available. In the study, I discovered the high status of the Companions’ sayings and deeds, from which the evidences of the jurisprudential rules were taken. Also, the sayings of the Companions have an impact on the jurisprudential rulemaking, as there is no jurisprudential rule that does not have a reference back to the sayings and deeds. In addition, the scholars of the nation who inferred those rules relied on the companions’ practices and understood from them their fatwas, sayings and deeds. Moreover, a lot of the Companions’ sayings and deeds indicate the subsections classified under major ones and which do not denote the rule holistically. In addition, some of the Companions’ sayings and deeds may be cited for more than one rule. That is an evidence that their practices contain a lot of meanings. | |
| dc.description.abstract | الاستدلال بأقوال الصحابة وأفعالهم على القواعد الفقهية دراسة استقرائية تحليلية بحث تناول جملة من القواعد الفقهية التي استدل لها بأقوال الصحابة وأفعالهم. وهذا الموضوع له أهميته وذلك لتعلقه بعلم القواعد الفقهية وهو من أعظم العلوم الشرعية وأنفعها وأجلها، وكونه يبحث في الاستدلال للقواعد الفقهية عند الصحابة المشهود لهم بالخيرية وهم أفضل الأمة بعد نبيها ، وكذلك من الأهمية أن جمع أقوال الصحابة وأفعالهم التي تدل على القواعد الفقهية من الكتب المتفرقة يبرز الأدلة ويجليها ويجعلها قريبة المنال لمن أراد النظر في مأخذ الفقهاء ومصدرهم في التقعيد الفقهي، ومن الأهمية أيضاً أن الاستدلال للقواعد الفقهية بأقوال الصحابة وأفعالهم يزيد في الطمأنينة للقاعدة الفقهية ويقوي الاستدلال بها والاستناد إليها في استنباط الأحكام الشرعية وتخريجها على القواعد الفقهية. وهذا البحث يحقق أهدافاً علمية من أبرزها جمع القواعد الفقهية التي استدل لها بأقوال الصحابة وأفعالهم وهذه القواعد هي: القواعد المندرجة تحت القواعد الكبرى، والقواعد الكلية غير الكبرى، وكذلك من الأهداف أنه يبين أثر أقوال الصحابة وأفعالهم في التقعيد الفقهي، ومن الأهداف أيضاً إبراز أهمية آثار الصحابة ودورها في ترجيح الخلاف في القاعدة ويقوم هذا البحث على المنهج الاستقرائي التحليلي ؛ وذلك باستقراء أقوال الصحابة وأفعالهم، والوقوف على القواعد الفقهية التي دلت عليها تلك الآثار. ويتحدث البحث عن التعريف بالقواعد الفقهية وحجية أقوال الصحابة وأفعالهم، وقمت بجمع القواعد الفقهية التي استدل لها بأقوال الصحابة وأفعالهم في كتب السنة والآثار والقواعد، ثم بينت المعنى الإفرادي وذلك بذكر معاني مفردات القاعدة، والمعنى الإجمالي للقاعدة ومفهومها وما يراد بها، وذكرت دليل القاعدة من قول الصحابي أو فعله، الاستدلال منه، وبينت أثر قول الصحابي في القاعدة في غير الاستدلال، وذكرت من استدل مع بیان وجهمن إجمالاً، وذكرت بعض الفروع الفقهية المندرجة تحت القاعدة، وذكرت بعض المستثنيات من القاعدة إن وجدت وتبين لي من خلال الدراسة علو مكانة أقوال الصحابة أفعالهم، وجلالة قدرها، ومن ذلك ما جاء فيها أدلة للقواعد الفقهية، وأن أقوال الصحابة لها أثر في التقعيد الفقهي، إذ ما من قاعدة فقهية إلا وتجد لها ما تستند عليه من أقوال وأفعال، وأن علماء الأمة الذين قعدوا القواعد الفقهية قد استندوا إلى آثار الصحابة وفقهوا عنهم فتاواهم وأقوالهم وأفعالهم الصادرة عنهم، وأن كثيراً من أقوال الصحابة وأفعالهم تدل على الفروع المندرجة ولا تدل على القاعدة دلالة كلية بطريق المطابقة، وأن بعض أقوال الصحابة وأفعالهم قد تدل على أكثر من قاعدة وهذا يدل على أن آثارهم تجمع المعاني الكثيرة. | |
