Abstract
جاءتْ هذه الرسالةُ بعنوان: "الذَّوقُ العامُّ – دراسةٌ تأصيليَّةٌ فقهيَّةٌ تطبيقيَّةٌ على النظام السعودي" بتأصيلِ وتحليلِ ما وردَ في لائحةِ المحافظةِ على الذَّوقِ العامِّ مِنْ مخالفات، وبيانِ حكمِها الشرعيِّ، وتكييفِها الفقهيِّ، وربطِ ذلك بالمقاصدِ العامَّةِ للشريعة، والأنظمةِ المعمولِ بها في المملكةِ العربيَّةِ السعوديَّة.
انتظمتْ خطَّةُ البحثِ في مقدِّمة، وتمهيد، وثلاثة فصول، وخاتمة، على النحو الآتي:
• التمهيد: تناولَ التعريفَ بمصطلحِ الذَّوقِ العامِّ ومفرداته، والمصطلحاتِ الشرعيَّةِ ذات العلاقةِ به، كالمروءة، والحياء، والآداب، وحسن المعاملة.
• الفصلُ الأوَّل: وفيه تحليلُ القواعدِ الفقهيَّةِ المؤصِّلةِ للائحةِ الذَّوقِ العامِّ، معَ بيانِ التأصيلِ الشرعيِّ للائحةِ مِنْ حيثُ المشروعيَّة، والاستنادِ إلى مقاصدِ الشريعةِ وقواعدِها العامَّة.
• الفصلُ الثَّاني: عرضُ مخالفاتِ الذَّوقِ العامِّ المنصوصِ عليها في اللائحة، وبيانُ تكييفِها الفقهيِّ، وتفصيلِها في ثلاثةِ مباحث: مخالفاتُ اللباس والمظهر، ومخالفاتُ الألفاظ والأصوات، ومخالفاتُ الأفعال، معَ دراسةِ ما يمكنُ إدراجُه مِنْ مخالفاتٍ غيرِ منصوصٍ عليها.
• الفصلُ الثَّالث: تناولَ الضوابطَ والشُّروطَ اللازمةَ لإثباتِ مخالفاتِ الذَّوقِ العامِّ، وعلاقةِ اللائحةِ بالأنظمةِ الأخرى ذاتِ الصِّلة، كالأنظمةِ الجنائيَّة، ونظامِ حمايةِ المرافقِ العامَّةِ وغيرِها.
• الخاتمة: وفيها أبرزُ النَّتائجِ والتَّوصيات.
وقدْ اعتمدَ البحثُ على منهجٍ تأصيلي تحليلي تطبيقي، باستقراءِ النصوصِ الشرعيَّة، ومقارنةِ أقوالِ فقهاءِ المذاهبِ الأربعة، معَ قياسِ الوقائعِ المعاصرةِ المذكورةِ في اللائحة على ما ثبت من أحكام.
ومِنْ أبرزِ ما توصَّلَ إليه البحثُ أنَّ الذَّوقَ العامَّ ليسَ مفهوماً طارئًا، بلْ هو مُتأصِّلٌ في مبادئِ الإسلامِ وآدابِه، وأنَّ المخالفاتِ الواردةِ في النِّظامِ السُّعودي يعودُ أصلُ تكييفِها ضمنَ أبوابِ الفقهِ الإسلاميِّ؛ ممَّا يجعلُها أداةً إصلاحيَّةً ذاتَ طابعٍ شرعيٍّ ونظاميٍّ في آنٍ واحد.
Description
This thesis, entitled "Public Decency – A Foundational and Applied Jurisprudential Study in Light of the Saudi Legal System", by Thamar Abdullah Al-Khalil, aims to examine and analyze the violations listed in the Public Decency Bylaw, clarify their Sharia rulings, present their jurisprudential classifications, and connect them with the general objectives of Islamic law and the applicable legal regulations in the Kingdom of Saudi Arabia.
The study consists of an introduction, preamble, three chapters, and a conclusion:
• The Preamble defines the term public decency and related Sharia-based concepts such as dignity, modesty, etiquette, and good conduct.
• Chapter One outlines the legal sources and jurisprudential principles underpinning the Bylaw, establishing its Sharia legitimacy and relation to legal maxims and objectives.
• Chapter Two presents the violations addressed in the Bylaw, classifying them into: dress and appearance, verbal and sound-related acts, and physical behavior, along with related unlisted violations.
• Chapter Three explores the evidentiary conditions for proving such violations and the Bylaw’s relation to other relevant legal systems such as criminal and public facility protection laws.
• The Conclusion highlights the main findings and recommendations.
The research adopts a foundational, analytical, and applied methodology, drawing on Sharia texts and comparing the views of the four Sunni schools while applying contemporary realities. It concludes that public decency is a deeply rooted Islamic concept, and that the Bylaw’s violations fall under recognized jurisprudential categories, making it a reformative tool with both legal and Sharia-based dimensions.
