Abstract
أهمية الموضوع : النّكاح من أوثق العقود في الإسلام، وبسبب التطور الطبي والصناعي في هذا العصر استجدَّت صورٌ للتّدليس في النكاح لم يذكرها الفقهاء في مصنفاتهم، تحتاج إلى بيان أثرها على عقد النكاح. وقد اشتملت الرسالة على مقدّمةٍ ،وتمهيد وخمسة فصول وخاتمة. النكاح. حدود البحث: اقتصرتُ في هذا البحث على ما استجد من صور للتدليس في النكاح في المملكة العربية السعودية. حيث تناولت الرسالة ما يلي: أولًا: عيوب النكاح، وأثرها على عقد النكاح، وضابط العيب الذي يثبت به خيار فسخ ثانيا : أثر التدليس في الأمراض المعاصرة بأنواعها، الأمراض المعدية . الإيدز، وفيروس الالتهاب الكبدي (ب) ، وأمراض الأعضاء التناسلية، وأمراض الدم الوراثية ، والأمراض غير المعدية، والأمراض النفسية، ومرض الصرع. ثالثًا: أثر التدليس في النسب، والمكانة الاجتماعية، والحالة المالية. رابعا: أثر التدليس في شرب الدخان، وتعاطي المخدرات. خامسًا: الأثر المترتب على نظر الخاطب لامرأةٍ أخرى على أنها مخطوبته تدليسًا. سادسا : أثر التدليس عند النظر إلى المخطوبة بالتَّزيُّن ،والتَّجمل، وعمليات التجميل. سابعا: أثر التدليس في الولي. ثامنا : أثر التدليس في موافقة المرأة على الزواج. تاسعا: الأحكام المترتبة على فسخ النكاح (المهر، والعِدَّة). وقد أوردت عددًا من الأحكام القضائية بفسخ النكاح بسبب التدليس الصادرة من المحاكم في المملكة العربية السعودية.
Description
This thesis is presented to the jurisprudence Department in Faculty of Sharia and Islamic Studies at Qassim University; to complete the requirements of obtaining the Master Degree in Comparative Jurisprudence. Topic Importance: Marriage is one of the most reliable contracts in Islam ،due to the medical and industrial development in this era; many fraud types in marriage have been emerged; jurists did not mention them in their indexes; which need to show their impact upon the marriage contract. Research Limitation: In this research; I only sought the fraud types in marriage which have been emerged inside "Kingdom of Saudi Arabia". This dissertation contains introduction ،preface ،five chapters and conclusion. The dissertation discuses what are follow: Firstly: Marriage's defects ،their affects to the marriage contract ،and the rules which may be followed to prove if this defect may due to make the choice of revocation the marriage. Secondly: The impact of fraud in all types of the contemporary diseases; either they are infectious diseases such as AIDS ،hepatitis B virus ،genital diseases and genetic blood diseases ،or they are non-infectious diseases ، Psychiatric diseases ،and Epilepsy. Thirdly: The impact of fraud in alliance ،social position ،financial position and complying with Sharia. Fourthly: The impact of fraud in smoking and taking drugs. Fifthly: The consequent impact of suitor seeing another woman on the basis of that she is his betrothed fraudulently. Sixthly: The impact of fraud when seeing the betrothed in full make up or after undergoing cosmetic surgeries. Seventhly: The impact of fraud in respect to the guardian. Eighthly: The impact of fraud in women's consent to marriage. Ninthly: Consequent provisions of the marriage revocation (dowry and waiting period). In this research; I included some judgments of revocation marriage in due to fraud; which were issued from courts in Kingdom of Saudi Arabia
