Abstract
تناولت هذه الدراسة النظم القانونية الدولية لتشجيع الاستثمار الأجنبي، وتمثلت مشكلة البحث في كيفية تفعيل تشجيع الاستثمار الأجنبي من أجل تحقيق التنمية الاقتصادية الدولية الشاملة. وهدفت الدراسة إلى إلقاء الضوء على النظام القانوني الدولي لتشجيع الاستثمار الأجنبي، وبيان الدور الذي تقدمه الأونكتاد في ذلك، والوقوف على معوقات التشجيع لإيجاد الحلول المناسبة التي تسهم في تشجيع الاستثمار الأجنبي. وقد خلصت الدراسة إلى قصور التنظيم القانوني الدولي لتشجيع الاستثمار الأجنبي بسبب عدم كفاية أحكام تشجيع الاستثمار وضعف الأثر التشجيعي في الاتفاقيات الدولية، بالإضافة إلى ضعف التعاون الدولي في هذا المجال، والافتقار إلى تنظيم دولي موحد للاستثمار الأجنبي.
وتوصلت الدراسة إلى عدة توصيات أهمها إقرار اتفاقية دولية موحدة لتنظيم الاستثمار الأجنبي، يكون هدفها تشجيع الاستثمار الأجنبي بما يحقق التنمية الاقتصادية الدولية الشاملة، ومعالجة قصور نظام التسوية الدولية لمنازعات الاستثمار بإنشاء محكمة دولية متخصصة في هذه المنازعات.
Description
This study dealt with the international legal systems to encourage foreign investment. The problem of research was how to activate the promotion of foreign investment in order to achieve comprehensive international economic development. The study aimed to shed light on the international legal regime to encourage foreign investment, to indicate UNCTAD's role in that, and to identify impediments to promoting appropriate solutions that contribute to the promotion of foreign investment. The study concluded that international legal regulation was inadequate to encourage foreign investment due to insufficient investment promotion provisions and weak promotional effect in international conventions, weak international cooperation in this area and lack of a unified international regulation of foreign investment. The study indicated several recommendations, the most important of which is the adoption of a unified international convention for the regulation of foreign investment, the objective of which is to encourage foreign investment to achieve comprehensive international economic development and to address the inadequacy of the international dispute settlement system by establishing an international tribunal specializing in such dispute
