| dc.description.abstract | يقوم هذا البحث على التعرف على أحكام رهن الأسهم كما هي مقررة في نظــام الرهن التجاري السعودي ، حيث تناولت هذه الدراسة كيفية حيازة هذه الأسهم وصورها وآثار رهن الأسهم ويتجلى ذلك في الالتزامات التي تقع على عاتق المتعاقدين وبالنسبة للغير وبالنسبة للراهن غير المدين ثم بينت هذه الدراسة دور هيئة سوق المال في رهـــن الأســهم ذلك في إنشائها مركزاً لإيداع الأوراق المالية ووضعت قواعد لهذا المركز ثم تحدثت ويتضح هذه الدراسة طرق انقضاء رهن الأسهم ومقارنتها بأحكام رهــن الأســهم في الفقـه ، حيث كشف هذا البحث الاتفاق الأغلب في الأحكام بينهما ، مـــا عــــدا الاسلامي عن الاختلاف في بعض المسائل و المسميات ، فرهن الأسهم يعتبر من عقود التوثيقات ، وهـو أداة فعالة لتوثقة الديون | |
