Abstract
بعد... وعلى آله وصحبه ومن تبعهم بإحسان إلى يوم الدين. أما فإن هذه الرسالة تتضمن مقدّمة، وتمهيد وثلاثة فصول وخاتمة، وفهارس، على النحو التالي: أولا: المقدمة وتكلمت فيها عن مشكلة البحث وأهميته، وأسباب اختياره، وأهدافه، ثم بينت حدود البحث المقتصرة على الجنايات والحدود، وبعد ذلك تطرقت إلى الدراسات السابقة، وما تميزت به رسالتي عن كل دراسة وتناولت منهج البحث والإجراءات المتبعة فيه. ثم التمهيد وفيه مبحثان: تكلمتُ في المبحث الأول عن التعريف بمصطلحات البحث لغة واصطلاحًا، ثم جاء المبحث الثاني في الألفاظ ذات الصلة، وهي: التوزيع، والتقسيم، والبدد، الحمد لله رب العالمين، والصلاة والسلام على المبعوث رحمة للعالمين، محمد بن عبد الله، بينت المعنى وصلته بالتفريق ثم تناولت في الفصل الأول أحكام التفريق في الجناية على النفس وما دونها، وفيه ستة مباحث، حيث جاء المبحث الأول في التفريق بين قصد الجاني في الجنايات على النفس وما دونها، ثم تطرقت للمبحث الثاني، وتكلمتُ فيه عن التفريق في عقوبة القتل العمد بين المسلم وغير المسلم، ثم جاء المبحث الثالث في الاعتداء بالضرب في أوقات وضربات متفرقة حتى الموت، يليه المبحث الرابع، وهو تفريق الأحكام بين شركاء الجناية على النفس وما دونها، وفيه خمسة مطالب المطلب الأول في التفريق بين الشركاء في حال الاتفاق، ثم المطلب الثاني التفريق بين الشركاء في حال التوافق، ثم المطلب الثالث التفريق بين الشركاء في حال الإعانة، ثم بعد ذلك المطلب الرابع في التفريق بين الشركاء في حال التحريض، ثم المطلب الخامس، وهو التفريق بين الشركاء بحسب حال كل شريك، وفيه ثلاث مسائل على النحو التالي: المسألة الأولى في التفريق بين الأب وشريكه في الجناية على الابن، ثم المسألة الثانية في التفريق بين الشركاء أحدهم فاقد الأهلية، ثم المسألة الثالثة وهي التفريق بين المكره والمكره، ثم تناولت في المبحث الخامس التفريق بين جنايات المكاتب ، وفيه مطلبان، جاء المطلب الأول في جناية المكاتب على الأجنبي، وبعده المطلب الثاني في جناية المكاتب على سيده، ثم تناولت في المبحث الأخير من الفصل الأول، وهو المبحث السادس في تفرق مواضع الموضحة. ثم انتقلت للفصل الثاني، وهو أحكام التفريق الحدود، وفيه ثلاثة عشر مبحثا: جاء المبحث الأول في التفريق بين إقامة أكثر من حد على شخص واحد، ثم تناولت في المبحث الثاني تفريق الضرب على الأعضاء في الحدود والتعزير، ثم جاء المبحث الثالث في تفريق الضرب وقت بعد وقت في الحدود والتعزير، ثم المبحث الرابع وهو التفريق بين الرجل والمرأة في حد الردة. ثم بعد ذلك المبحث الخامس قذف الجماعة بكلمة وتفرقهم في طلبه، ثم المبحث السادس: قذف الجماعة بكلمات متفرقة. ثم المبحث السابع التفريق في عقوبة القذف والزنا بين المسلم وغير المسلم، وفيه مطلبان جاء المطلب الأول : في التفريق في عقوبة القذف بين المسلم وغير المسلم ، والمطلب الثاني في التفريق بين عقوبة الزنا بين المسلم وغير المسلم، ثم المبحث الثامن التفريق بين المرأة والرجل في عقوبة الزنا حال الإكراه، ثم تناولت في المبحث التاسع تفريق سنة ،التغريب، ويليه المبحث العاشر في الشرقة من أحراز متفرقة، ثم في المبحث الحادي عشر التفريق بين موجبات القطع في حدّي الحرابة والشرقة، ثم جاء المبحث الثاني عشر عن تفريق القطع في حد الحرابة، ثم المبحث الثالث عشر في تفريق نفي الجماعة في حد الحرابة. ثم جاء الفصل الثالث، وهو أحكام التفريق في الشهادة والبينة في الجنايات والحدود، وفيه سبعة مباحث تكلمت في المبحث الأول عن شهادة الصبيان في الجراح مالم يتفرقوا، وتناولت في المبحث الثاني عن تفريق شهود الزنا، ثم المبحث الثالث: تفرق مجالس شهود الزنا، وجاء المبحث الرابع في تفريق ناقلي شهادة الزنا، وتطرقت في المبحث الخامس إلى تفرق مجالس إقرار الزاني، ثم تكلمت في المبحث السادس عن تفريق أيمان القسامة في الزمان أو المكان. ثم جاء المبحث السابع والأخير في تفرق بيئة القسامة من جماعة مختلفة وفيه مطلبان: المطلب الأول: تفرق بينة القسامة ممن تقبل أخبارهم في الدين والمطلب الثاني في تفرق بينة القسامة ممن لا تقبل أخبارهم في الدين ثم الخاتمة واشتملت على أبرز النتائج والتوصيات، ثم الفهارس

Praise be to God, Lord of the Worlds, and prayers and peace be upon the one who was sent as a mercy to the worlds, Muhammad bin Abdullah, his family, his companions, and those who followed them with charity until the Day of Judgment, and then. This study contains an introduction, preamble, three chapters, a conclusion, and indexes, as follows: First: The introduction , I talked in it about the problem and the importance of the research, the reasons for choosing it, and its objectives, then I explained the limits of research that are limited to crimes and prescribed punishments, and then I compared my study with previous studies and clarified what distinguished my thesis from each study, and I also talked about the research methodology and the procedures followed in it. Then the preamble, which included two topics: In the first topic, I talked about the definition of search terms linguistically and conventionally. Then, in the second topic, I talked about the related terms, which are distribution, division, and dispersal, and explained its meanings and linked them to discrimination. Then I talked in the first chapter about the provisions of discrimination in crimes against the human being and below, and this chapter contained six topics. In the first section, I focused on discrimination between the intention of the wrongdoer in crimes against human being and below. Then I moved to the second topic and talked about discrimination of the penalty for premeditated murder between Muslim and non-Muslim. Then, in the third topic, I talked about beating at different times and the separate strikes that lead to death. Then, in the fourth topic, I talked about discrimination of judgments between accomplices of the crime against human being and below, and it contained five demands: The first demand was the discrimination between accomplices in the event of an agreement. Then the second demand, which was the discrimination between accomplices in the event of consensus. Then the third demand was the discrimination between accomplices in the event of aid. Then the fourth demand was about discrimination between accomplices in the event of incitement. Then the fifth demand was about discrimination between accomplices according to the condition of each accomplice, and it involved three issues as follows: The first issue was about discrimination between the father and his accomplice in the crime against the son. Then the second issue was about discrimination between accomplices, where one of them was incompetent. Then the third issue, which was the discrimination between forced and impeller acomplices. Then, in Section Five, I talked about the discrimination between the crime of covenanted subject , and there were two demands: The first demand was about the crime of covenanted subject against the foreigner, and after it the second demand was about the crime of covenanted subject against his master. Then I spoke in the sixth topic about the discrimination of the described topics. Then I moved to the second chapter, which about the provisions of discrimination of prescribed punishments, which contains thirteen topics: The first topic was about discrimination between setting up more than one prescribed punishment on one person. Then I dealt in the second topic with the discrimination of beating parts of body in terms of prescribed and discretionary punishment. Then the third topic was about discrimination of the beating time after time in the discretionary and prescribed punishments. Then the fourth topic, which was about the discrimination between a man and a woman in the punishment of apostasy. Then the fifth topic about accusing a group falsely as as a whole and discrimination them in his punishment. then the sixth topic was about accusing a group falsely by using the names of its members. Then the seventh topic was about the discrimination in the punishment for accusing falsely and the punishment for adultery between Muslim and non-Muslim. Then the eighth topic was about the discrimination between a woman and a man in the punishment adultery in the case of coercion. Then the ninth topic was about the exile for one year. The tenth topic was about stealing from different places. the eleventh topic was about discrimination between the terms of cutting hand in the prescribed punishments of stealing and highway robbery. The twelfth topic was about the discrimination of cutting in the prescribed punishment of highway robbery. Then the thirteenth topic was about the discrimination the denial of the group in terms of the prescribed punishment of highway robbery. In the third chapter, I talked about the provisions for discrimination of testimony and evidence in crimes and prescribed punishments, and it contains seven topics: In the first topic, I talked about the testimony of boys against each other unless they disperse. In the second topic I talked about the discrimination of the witnesses of adultery. In the third topic I talked about the different places of the witnesses of adultery. In the fourth topic I talked about the discrimination of the persons carrying the testimony of adultery. In the fifth topic I talked about the different places of declaration of adultery. In the sixth topic I talked about the discrimination of collective oath according to place and time In the seventh and last topic I talked about the dispersion of the proof of the blood money among different groups of people. it has 2 requests; the first request is the dispersion of the proof for the blood money among who were informed about the debit, and accepted and the second request includes the dispersion of the proof for the blood money who were not accepted to be informed about the debit, then the conclusion which included the major results, recommendations, then the indexes
