| dc.description | This research explains the essence of the lapse of procedural right and focuses on differentiating it from other penalties that may resemble it. This research also brings together instances of lapse of procedural right in the Saudi Sharia judicial system and its amendments. This will be done through inspecting standard texts and executive regulations which are consistent with the provisions of the Islamic Sharia and the standards of justice systems in the world. Moreover, the research touches upon examples from Saudi court cases about the application of the lapse of procedural right in order to preserve the rights of litigants, achieve swift justice, prevent the escalation of disagreements and clear the courts from vexatious actions and stagnant cases | |
| dc.description.abstract | يقوم هذا البحث ببيان ماهية سقوط الحق الإجرائي ويركز على التفريق بينه وبين الجزاءات الأخرى التي قد تتشابه معه ، كما يقوم هذا البحث بحصر حالات سقوط الحق الإجرائي في نظام المرافعات الشرعية السعودي وتعديلاته ، من خلال تتبع النصوص النظامية واللوائح التنفيذية ، والتي تتفق مع أحكام الشريعة الإسلامية ومعايير الأنظمة العدلية في العالم ، ويتطرق إلى شواهد من قضايا المحاكم السعودية على تطبيق مظاهر سقوط الحق الإجرائي ، حفاظاً على حق المتخاصمين في تحقيق العدالة الناجزة وعدم الإلداد في الخصومات وتخليص المحاكم من الدعاوى الكيدية والدعاوى الراكدة | |
