Abstract
تتناول هذه الرسالة وسائل الإثبات المستجدة في نظام الإثبات الصادر بالمرسوم الملكي (م/٤٣) بتاريخ: 26/5/1443ه، بالنسبة لنظام المرافعات الشرعية، وقد وردت في النظام العديد من المسائل المستجدة، منها ما كان نازلة فقهية، ومنها ما هو مستجد على النظام، لكن سبق أن تحدث عنها الفقهاء.
وقد تحدثت الرسالة عن هذه المسائل بتوضيح معناها، وبيان كونها من المسائل المستجدة، وذكر حكمها، وأظهرت الرسالة اختيارات النظام الفقهية، وأدلتها، مع بيان أدلة الأقوال الأخرى، وبيان وجه ترجيح القول الذي اختاره النظام، إذا كانت المسألة مما نص عليه الفقهاء رحمهم الله، وإن كانت من النوازل فسلكت مسلك التخريج على المسائل التي نصوا عليها، والبحث عن النصوص التي يمكن أن تلحق بها، أو الأصول الشرعية العامة.
وبعد عرض جميع المسائل على وفق هذه الطريقة، خلصت إلى نتيجتين وهما:
الأولى: جميع المسائل لم تخرج عن أحد أقوال الفقهاء، إما بالنص على المسألة، أو التخريج عليها.
الثانية: جميع المسائل موافقة لبعض النصوص الشريعة، أو أحد الأصول العامة في الشريعة والقضاء.
وبهذه الرسالة يتبين قوة مأخذ النظام الفقهي، وتتبين الأقوال الأخرى التي عمل بها الفقهاء في القضاء بمثل هذه المسائل، ومدى قوة أدلتها.
This study discusses the modern evidential tools in the Saudi Arabian evidence law, established under royal decree (M/43) on 26/5/1443 H. Regarding the Sharia Litigation Law, it includes several newly emerging subjects. Some of these are entirely new, while others are new to the law itself but have been previously discussed by jurists. This study discussed these subjects by clarifying their meaning, whether they are classified as modern tools, the legal ruling. In addition, the study presented the jurists' choice, the used evidence, along with demonstrating the evidence of the other statements, and clarifying the most valuable statements chosen in this law. In the other case, if these subjects are completely new, they are based on the established statements stated by the jurists, including any related subjects or general principles. After presenting all the subjects in this manner, two main conclusions have been drawn: (i) the first: the subjects did not contradict any jurist's statements. (ii) the second: the subjects align with some of Sharia’s statements, or one of the general principles in Sharia and judicial. In conclusion, this study demonstrates the strength of the jurisprudential system, presenting the different jurists’ statements regarding this matter, as well as highlighting the strong evidence supporting the matter.
